Treatment Liability coverage vs Professional Indemnity

Risk Control

In recent times, we have noticed an increasing number of local authorities asking care operators to prove they have professional indemnity insurance (PI) in place for their business. For the vast majority of care providers this is simply not necessary as most care packages include cover within the public liability wording.

Understanding the dilemma:

These requests arise due to a lack of understanding about the services provided by these providers or possibly some confusion as to what professional indemnity is intended for. Whilst it is true that many care staff administer medication to residents or clients, only qualified nurses and doctors engage in diagnosing medical conditions, prescribing drugs or providing extensive medical treatments. Consequently, the need for full PI or medical malpractice coverage is redundant.

Overcoming the stress:

It is completely understandable that our clients may feel overwhelmed when local councils request insurance coverage that is not applicable to their operations. The fear of non-compliance and potential funding implications can create unnecessary stress. However, it is crucial to remember that care home and domiciliary care providers do not hire doctors or medical professionals who would typically require this specific coverage. By understanding the nature of the services they provide, it becomes easier to address these requests with confidence.

Navigating the insurance landscape:

As experienced insurance brokers, our primary goal is to support our clients in securing the right coverage while minimising unnecessary costs. In the case of Treatment/Medical Malpractice coverage requests, we work closely with our clients to communicate effectively with local councils, explaining the specific nature of their operations. By providing clear and concise information about the scope of their services, we aim to alleviate concerns and promote a better understanding of the appropriate insurance coverage required.

Tailored Insurance solutions:

At Quality Care Group, we recognise that every care home and domiciliary care provider is unique. We take pride in offering tailored insurance solutions that meet the specific needs of our clients. In 95% of cases the standard treatment liability, sometimes referred to as professional liability, is more than adequate. This looks after the carer who administers the prescribed medication and general care which has been decided by a nurse or other medical professional who carries the full PI cover themselves. Full Professional Indemnity insurance coverage provides protection against claims of negligence, errors, or omissions related to professional services rendered. Naturally, in situations where our client carries out such technical duties then we can provide the necessary policy.

Conclusion:

As the largest independent insurance broker to the care sector, Quality Care Group is dedicated to simplifying insurance requirements for care home and domiciliary care providers. We understand the concerns our clients face when local councils request wider coverage despite this not being relevant to their operations. By effectively communicating with local councils and providing the necessary information, we aim to alleviate the anxiety associated with these requests.
