This recent article from the Telegraph serves to demonstrate how litigious the sector is. Whilst the vast majority of care providers run their businesses well there seems to be a small element of poorly run operations that tarnish the general reputation of social care in this country. This creates an environment in which negligence is searched out even when there is none apparent.
More than ever before care providers need to be considering Directors & Officers (Management Liability) Insurance cover as this is the only true protection to defend against this sort of action. The best policies will activate defence against action from all typical sources including those mentioned plus those from regulators such as HSE, CQC and the like.
The personal assets of the directors as well as those of the company are at risk from such litigation. The cost of defence can be extreme but the policy will step in whether the plaintiff has a strong case or no case at all.
